Man who raped minor gets sentence reduced
SEREMBAN: A 32-year-old odd-job worker had his jail sentence for raping a minor reduced by 10 years, after the High Court here took into consideration that he was a first-time offender and had cooperated with the police.
Kamarul Abdul Razak, from Rumah Rakyat Serting Tengah in Batu Kikir near here, was sentenced last year by the Kuala Pilah Sessions Court to 18 years’ imprisonment and six strokes of the cane for raping the girl, who was then 15 years and six months old.
He committed the offence at a rubber estate at KM3, Jalan Serting-Air Hitam on Aug 3, 2001.
Judicial Commissioner Datuk Ahmad Nasfy Yasin said the Sessions Court judge had been thorough and looked at all aspects of the law before sentencing Kamarul.
“I have also read the testimonies by the victim, her sister and other witnesss and found their stories to be consistent.
“I have also perused through police investigation papers and I have no doubt that you did rape the girl … the Sessions Court judge was right in finding you guilty,” he said.
However, Ahmad Nasfy said he also took into consideration that the accused was not violent against the victim in deciding to reduce his sentence.
“I therefore reduce your sentence from 18 years to eight years. However, the six strokes of the rotan shall remain,” he said, adding that Kamarul’s sentence would begin from Thursday.
Kamarul was represented by Lt Cmdr (Rtd) Mohammed Azmi Mohd Said while Wan Shaharuddin Wan Ladin prosecuted.

In announcing this today, Defence Minister Datuk Seri Dr Ahmad Zahid Hamidi said the submarine “is rectified and can dive. It is fully operational“.
He said this after the deployment of the International Monitoring Team-Mindanao V (IMT-V) at the Royal Malaysian Air Force base here today.
Asked if he had participated in the submarine’s test dive, Ahmad Zahid said he was advised against it but stressed he had faith in the Royal Malaysian Navy officers.
